A property qualifies for an exemption from the pied-à-terre surcharge if it is the primary residence of any of the following:
- The owner of the property.
- A tenant or subtenant.
- One or more individuals who collectively hold a majority interest in the LLC, corporation, or partnership that owns the property.
- An immediate family member of the owner or majority interest holder.
- The sole beneficiary of a trust.
For the list of documents that must be uploaded when submitting the application, visit https://www.nyc.gov/site/finance/property/non-primary-residence-surcharge.page.
The exemption application is an alternative to waiting to appeal an adverse primary residence determination notice. The Department is required to mail the notices to impacted property owners by August 30, 2026. Affected owners will have thirty (30) days from the date the notice is transmitted (i.e., the date listed on the notice) to file an appeal for an adverse primary residence determination.
